Role profile

This is a team that has "a glowing reputation for commercial litigation" (Chambers & Partners) and "fields an 'insightful, tactful and incredibly skilled' team capable of acting across complex, high-value regulatory investigations and enforcement actions, including anti-money laundering, whistleblowing, safeguarding, cyber issues, market abuse, and non-financial misconduct" (Legal 500)

 Due to continued growth we have an exciting new opportunity for a Commercial litigator, with experience in Financial Services litigation and regulatory investigations, to join our well regarded and successful Commercial Disputes team at Associate level.

The practice

Osborne Clarke's commercial disputes practice provides a full range of commercial dispute resolution and specialist risk management services, both nationally and internationally.

 Led by a team of partners with a City background, our team acts on a wide range of litigation and crisis management mandates for a broad range of international and domestic clients, including market leaders in financial services, technology, telecoms, retail, Energy, mobility and infrastructure and various other sectors

Within that practice, our financial services litigation and regulatory investigations work is a key area of focus. We advise a broad range of financial services clients, including banks, asset and wealth managers, payment and emoney institutions, fintechs, alternative lenders, PE/VC-backed platforms, listed companies and senior individuals. We act on:

  • Financial services disputes (including contractual, mis-selling and consumer claims, and complex multiparty litigation);
  • Regulatory and enforcement matters (FCA, PRA and other domestic and overseas regulators);
  • Internal and regulatorydriven investigations, including into systems and controls, market conduct, consumer protection and governance issues;
  • Contentious regulatory and governance issues for boards and senior management, including SMCR-related matters;
  • Crossborder disputes and investigations involving multiple jurisdictions and regulators;
  • Claims against and other advice for the Financial Services Compensation Scheme.

The wider Commercial Disputes team has a particularly strong reputation for disputes in the technology and life sciences sectors, Private Equity / Venture Capital and other corporate finance issues, corporate disputes (including posttransaction and shareholder and boardroom governance disputes), commercial fraud, investigations and work in the antibribery and corruption sphere.

The team is fully integrated into a fastgrowing national and international network which includes rapidlyexpanding offices across Osborne Clarke's international platform.

The team

Headed by highly respected commercial and corporate litigators, Osborne Clarke’s Commercial Disputes team handles strategically important, highly complex, crossborder and national disputes and investigations. Members of the team frequently work on a crossoffice basis with colleagues in Bristol, London and Reading, as well as with teams across Osborne Clarke's international network.

This role will sit within the broader Commercial Disputes team but with a significant proportion of work drawn from:

Financial Services litigation, both for financial services institutions and the Financial Services Compensation Scheme; and

Investigations, including internal investigations, regulatorydriven investigations and investigations related to potential litigation or enforcement.

You will work closely with partners and senior lawyers specialising in financial services disputes, regulatory enforcement, corporate and regulatory investigations, and with colleagues in our noncontentious Financial Institutions, Tech, Media & Comms and Corporate teams.

The department is growing, increasing the breadth and depth of its expertise and resource, as part of the overall strategic growth of Osborne Clarke's UK offices and the firm as a whole

The role

We are looking for an Associate to join the Commercial Disputes team with a focus on:

  • General commercial litigation, including High Court claims and complex commercial disputes;
  • Financial services disputes, including mis‑selling and consumer claims, product and service disputes, claims against, and regulatory issues for, payment and emoney institutions, and professional or negligence‑type claims;
  • Contentious regulatory work and enforcement, particularly involving the FCA and PRA (and, where relevant, other regulators); and
  • Corporate and regulatory investigations (internal and external), including investigations supporting potential litigation or enforcement action.

You will have early responsibility, direct client contact and the opportunity to work on high profile and cutting‑edge matters in the financial services and technology/fintech sectors.

Technical skills and experience

We are looking for evidence of broad knowledge and experience in this area and for potential to excel.

Due to the nature of the work and practice we are looking to appoint an Associate, however we are happy to consider applicants with more or less experience.

Your career development

Like all our lawyers, you will benefit from our multi-award winning career development programme. At each stage of your career this provides you with:

  • clear expectations of your role and what it takes to progress;
  • high quality clients and work, with early responsibility and client exposure;
  • thorough assessment and individual feedback from a range of experienced colleagues;
  • robust technical training with early skills based development, increasingly tailored to you; and
  • reward for your contribution, progression and potential, rather than PQE or tenure.

Location

Our UK offices are in London, Bristol and Reading.
